East Midlands Farm Waste Recycling Scheme Using the Solway Bin and Liner System.
Terms and Conditions of sale of service by Harby Agriculture Ltd.
Harby Agriculture Ltd (The Company) agrees to collect farm waste packaging from a farm customer (The Producer) subject to the following terms and conditions.
Waste handling
The producer agrees to segregate all non-hazardous farm waste at point of production and to keep it as clean as is practically possible by placing it and storing it in a liner within a Solway bin (Optional). Solway bins can be purchased from the company or any other retailer of Solway Bins. The Producer agrees to triple rinse chemical containers prior to collection. Foils and lids can be placed in the same liner providing they are also triple-rinsed. Fertiliser bag inners and outers do not need to be separated. The company will collect liners full of non recyclable material as long as the quantity does not exceed 25 % of total waste collected. Examples of non recyclable material are string, net wrap, drainage pipe etc.
Collection
Collection can only be made in large plastic liners available from the company or any other supplier of Solway bins. The producer will inform the company by telephone or fax when liners are ready for collection. The producer will place the full liners with tops securely tied in a place readily accessible by lorry for the Company to collect on any day of the week Monday through to Sunday inclusive. The company will give advance notice of which day and what estimated time collection is planned. The Producer will triple rinse all pesticide containers prior to placing them in the liner. The company will provide stickers with a unique producer number, one of which the producer will attach to each liner prior to collection by the company. Liners which show evidence of contamination whether hazardous or non-hazardous will not be collected by the company and a wasted journey charge may be levied to the producer. Producers who send liners that are subsequently found to be contaminated (for example containing cans still full of pesticide) will be charged the full costs of proper environmental disposal.
Payment
The Producer agrees to pay for the collection of all liners in advance and these payments are known as collection credits. Collection credits must be purchased in a minimum quantity of three. There will be a minimum annual charge per season of three collection credits even if the producer does not request three liner collections. The season runs from 1st July each year to the 30th June the following year. Payment of the minimum annual charge is due on 1st of July each year. The company may at any time vary the price of the collection credits. The company retains the right to refuse collection of all or any waste and refund the producer any outstanding collection credits.
Proof of Transfer for regulatory bodies
The company will provide documentary evidence of collection of waste to the producer by providing waste transfer notes. Such waste transfer notes will give details of the waste carriers license number and will be uniquely numbered to allow traceability by the regulatory bodies. Waste transfer notes will be issued by the collecting driver on each and every collection detailing the nature and quantity of waste collected. Waste transfer notes are required by law and must be retained by the producer as proof to the Environment Agency, Farm assurance inspector or other enforcing body that the producer has complied with his duty of care for the disposal of waste.
